If your zoning application is denied by the Zoning Official, and you wish to proceed with a variance, you can obtain an application to come before the Board from the municipal website, belviderenj.net (Government, Planning Board, Forms & Checklists, “Planning/Zoning Board Applications”). Once your application is submitted with the requisite fees and escrow, you will be scheduled for the next meeting of the Board (1st Tuesday of each month) for the Completeness Hearing. Engaging an attorney familiar with land use is advisable. The Board has a Planner and an Attorney that are there to advise the Board, not individuals. Your application will receive a completeness review by the Planner and his recommendations will be reviewed by the Board at the Completeness Hearing. If your application is deemed “complete” you will be scheduled for the public hearing at a subsequent meeting. If your application is deemed “incomplete” you will need to make the required corrections/changes and resubmit for Completeness. The variance process takes two months, at a minimum.
